These Terms of Service (“Terms”) govern your use of raahtraders.com (the “Site”) and any purchase from Raah Traders (“Raah Traders”, “we”, “us”). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Returns & Refunds policy, which are part of these Terms. Please read Section 12. It contains an arbitration agreement and class action waiver that affect your legal rights.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, and located in the United States to make a purchase. By placing an order, you confirm that you meet these requirements and that the information you provide is accurate and complete.
2. Products, descriptions and availability
- We try to describe and display products accurately. Images are for illustration, and actual color, size, packaging and minor design details may vary. Measurements are approximate.
- Products are sourced from and shipped by independent suppliers and warehouses. Availability can change at any time, and we may limit quantities or discontinue products without notice.
- Product descriptions are not a warranty that a product is fit for any particular purpose beyond its described use.
3. Pricing and payment
- All prices are in US dollars. Applicable sales tax is calculated at checkout.
- Despite our efforts, a product may occasionally be listed with the wrong price or description. If so, we may cancel the order and refund you in full, even after it has been confirmed or charged, or contact you with the correct details first.
- You authorize us and our payment provider to charge your selected payment method for the total amount of your order.
4. Order acceptance and cancellation
Your order is an offer to buy. Your order confirmation email confirms that we received it, not that we accepted it. We accept an order when the item ships. We may refuse or cancel any order, with a full refund of any amount charged, for reasons including: the product is unavailable; there is a pricing or listing error; we suspect fraud, an unauthorized payment or resale abuse; or we can’t verify your information.
5. Shipping, title and risk of loss
We ship only within the United States. Delivery dates are estimates, not guarantees. This includes holiday delivery dates. Title to the products and risk of loss pass to you when we hand the products to the carrier. Even so, we’ll help with lost or damaged packages as described in our Shipping Policy.
6. Returns and refunds
Returns and refunds are handled under our Returns & Refunds policy. Please contact us before opening a dispute or chargeback with your bank. Most problems can be resolved faster directly. We may cancel pending orders and suspend accounts involved in fraudulent claims or chargebacks.
7. Product safety and use
- Read and follow all instructions, warnings and age recommendations that come with a product. Use products only for their intended purpose.
- Electrical, heated, battery-powered and lighting products must be used as directed. Don’t leave them unattended while in use. Keep them away from water unless rated for it, and away from flammable materials. Supervise their use around children and pets.
- Holiday decorations, candles, lights and costumes should be kept away from open flames and heat sources.
- Vehicle accessories, such as phone mounts and organizers, must be installed so they don’t block your view, controls or airbags. Never handle a device while driving.
- Fitness and exercise products: consult a medical professional before starting any exercise program. Stop using a product if you feel pain or discomfort.
- Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any condition.
8. Warranty disclaimer
Except as stated in our Returns & Refunds policy, and to the fullest extent permitted by law, the Site and all products are provided “as is” and “as available”, without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Any warranty provided by a product’s manufacturer is the manufacturer’s responsibility. Some states don’t allow certain warranty exclusions, so some of these exclusions may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, Raah Traders and its owners, employees, suppliers and service providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages. This includes lost profits, lost data, personal or event inconvenience, and missed holiday or event dates. It applies to anything arising from or related to the Site or any product, even if we were told such damages were possible. Our total liability for any claim related to an order or product is limited to the amount you paid for that product. Some states don’t allow these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that can’t be limited under applicable law, or rights you have under consumer protection laws that can’t be waived.
10. Indemnification
You agree to defend, indemnify and hold harmless Raah Traders and its owners, employees and service providers from any claims, losses, damages, liabilities and expenses, including reasonable attorneys’ fees, arising from: your misuse of a product or of the Site; your breach of these Terms; or your violation of any law or third-party right.
11. Acceptable use of the Site
You agree not to: use the Site for any unlawful purpose; place fraudulent orders; interfere with or disrupt the Site or its security; scrape, copy or harvest content or data by automated means; attempt to access accounts or data that aren’t yours; or upload anything harmful, offensive or infringing. We may suspend or close accounts that violate these Terms.
12. Dispute resolution: arbitration and class action waiver
- Informal resolution first: before filing any claim, you agree to email admin@raahtraders.com with a description of the issue. We’ll try in good faith to resolve it within 30 days.
- Binding arbitration: if we can’t resolve it informally, you and Raah Traders agree that any dispute arising from or relating to these Terms, the Site or any product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies.
- Class action waiver: to the fullest extent permitted by law, disputes will be handled only on an individual basis, not in a class, consolidated or representative action, and you and we each waive the right to a jury trial.
- Opt-out: you may opt out of this arbitration agreement by emailing admin@raahtraders.com within 30 days of your first purchase. Include your name, email and the subject line “Arbitration Opt-Out”.
- If any part of this Section 12 is found unenforceable, that part will not apply, and the rest of Section 12 will remain in effect. If the class action waiver is found unenforceable, the entire arbitration agreement will not apply to that dispute.
13. Governing law
These Terms are governed by the Federal Arbitration Act and the laws of the United States and of the state in which Raah Traders is organized, without regard to conflict-of-law rules. This does not apply where your state’s consumer protection laws require otherwise.
14. Events outside our control
We aren’t responsible for delays or failures caused by events beyond our reasonable control. Examples include carrier and postal delays, supplier or warehouse disruptions, severe weather, natural disasters, labor disputes, government actions, pandemics, internet or utility outages, and peak holiday volumes.
15. Intellectual property
Site content, design, text, graphics and logos belong to Raah Traders or its licensors and may not be copied, reproduced or used without written permission. Third-party brand names appear only to describe compatibility. Their use does not imply endorsement or affiliation.
16. Reviews and submissions
If you submit reviews, photos, questions or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, display and reproduce it in connection with the Site and our marketing. You confirm that you have the right to share it and that it is accurate and lawful. We may remove any submission at our discretion.
17. General
- These Terms, together with the policies referenced above, are the entire agreement between you and Raah Traders about your use of the Site and your purchases.
- If any provision is found unenforceable, the remaining provisions stay in effect.
- Our failure to enforce any provision is not a waiver of it.
- You may not transfer your rights under these Terms. We may assign ours, for example in a business transfer.
- We may update these Terms. The version posted at the time of your order applies to that order.
